On 26 August 2024, the Fair Work Act 2009 (Cth) (Fair Work Act) will be changing the definition of employee. Many businesses engage contractors and should understand what this new definition means for their current and future contracting arrangements. Businesses will need to be aware of any entitlements they may owe to contractors. One important entitlement for businesses to consider is the requirement to pay superannuation to certain contractors.
On 6 December 2023, the Australian Taxation Office (ATO) issued the Practical Compliance Guideline PCG 2023/2 – Classifying workers as employees or independent contractors – ATO Compliance Approach (PCG), which sets out the Commissioner’s approach for reviewing the relationships of businesses that engage workers who may either be independent contractors or employees.
We will address the following in the webinar:
- The current common law definition of employee;
- The new definition of employee in the Fair Work Act;
- The ‘Opt Out’ provisions in the Fair Work Act;
- Superannuation entitlements for certain contractors under the Superannuation Guarantee (Administration) Act 1992 (Cth);
- The ATO’s PCG and how it assists businesses; and
- What businesses can do to prepare for changes to the legislation.
