Victoria has released a free e-learning module on Statutory Duty of Candour
(SDC). The program aims to explore a range of perspectives of SDC with
consumers, clinicians, executives and lawyer.
As part of this resource pack, Russell Kennedy principal Michael Gorton AM, was invited to participate in the program to give his legal perspective. Michael features in a series of short video presentations, which cover the following topics:
- Why is duty of candour a legal obligation now in Victoria?
- What is the risk (if any) and benefit to clinicians when they participate in duty of candour?
- What would be your top three tips for clinicians to comply with the duty of candour requirements?
- What is your advice to boards and executives who are concerned about participating in duty of candour?
- Where non-compliance occurs, what consequences could health services face?
Michael chaired the Expert Advisory Committee which made recommendations to the Victorian Government for the SDC legislation. Michael has extensive experience in the health sector, corporate governance and clinical governance – and is the Board Chair of Alfred Health.
