The article covers the new Aged Care Act’s representatives regime and provides an overview of what is known so far. Among the many proposed changes in the new Aged Care Act is an entirely new ‘nominees’ regime which appears to override the existing state-based system for substitute decision-makers.
The article discusses changes relating to aged care decision-making, and introduces the concept of an 'Aged Care Act nominee' who will make decisions for older persons lacking capacity. It also covers:
