Principal Kylie Walsh and Lawyer Jamila Shirzad have had an article published in the Australian Health Law Bulletin titled ‘Disciplinary action against a medical practitioner for aiding and abetting suicide — Health Care
Complaints Commission v Godwin’.
The article provides an overview of the conduct and criminal proceeding relating to voluntary assisted dying legislation.
The Health Care Complaints Commission applied for disciplinary findings against a registered medical practitioner under the Health Practitioner Regulation National Law as adopted in New South Wales (National Law) for aiding and abetting in the suicide of his partner (patient) in 2014 contrary to s 31C(1) of the Crimes Act 1900 (NSW).
