Home Care

Russell Kennedy is a market leader in the home care sector.

We assist clients navigating the complex regulatory compliance environment and the commercial challenges of home care, whether as an existing provider or a new entrant.

We provide a complete range of home care client agreements and brokered services agreements which we maintain for clients through our subscription service. These are accompanied by our Easy English illustrated guides which assist providers in helping their clients to understand.

We offer template policies and procedures, such as dignity of risk forms, whistleblower policies, privacy policies and our detailed home care expenditure policy which helps providers and their staff navigate the complexities of deciding what clients can and can’t purchase with their home care funds.

When issues arise, we assist providers with all aspects of compliance in this space including responding to the Aged Care Quality and Safety Commission, and the Department of Health and Aged Care, managing complaints and responding to the Coroner as well as other authorities. We represented numerous home care clients in the Aged Care Royal Commission.

We also provide a broad range of commercial services to providers in this sector and have assisted with acquisitions of home care businesses, both on the vendor and purchaser sides including conducting comprehensive due diligence.

We provide training to providers’ staff on a broad range of issues on topics such as defensible documentation, consent, restraint and dignity of risk. We conduct specialised workshops for aged care boards and executives on governance.

Our depth of regulatory compliance experience and expertise with governance matters ensures we can help providers review their governance practices and develop recommendations for a more effective governance operating model.

Our direct home care experience includes:
  • Assisting providers in understanding their legislative and regulatory compliance responsibilities under the Aged Care Act and other laws including privacy and represented persons.
  • Reviewing existing governance practices and presenting recommendations to clients.
  • Assisting home care providers in relation to the pricing transparency changes.
  • Representing providers in responding to regulatory bodies.
  • Producing home care client agreements, client agreements, risk audit templates, whistleblower policies, commercial contracts and agreements.
  • Assisting providers with mergers and acquisitions, due diligence and risk asset assessment.
  • Conducting training to boards, executives, facility managers and staff.
