Damian has broad experience in a variety of commercial property transactions, practising primarily in the areas of property development, property acquisitions and dispositions, and commercial and retail leasing. He is licensed to practice in Australian jurisdictions and New York.

Experience

  • Advising and representing public and private corporate clients, institutional investors, property developers and individuals in property sale and purchase arrangements, including contract negotiations and advice, due diligence, conveyancing, and navigating complex legal issues associated with such transactions, including environmental contamination and land encumbrances
  • Representing and advising both landlords and tenants of retail, commercial and industrial premises in all aspects of leasing transactions, including preparation of bespoke leasing documentation and agreements for lease, as well as conduct of tenancy disputes and mediation
  • Acting for property developers in relation to off-the-plan projects (commercial, residential, mixed-use and broadacre subdivisions), including preparation of pro forma and bespoke sales contracts, purchaser negotiations, and supervising high-volume conveyancing
  • Advising in relation to issues associated with real property transactions, including subdivision and owners corporation matters, planning (including section 173 agreements), FIRB, stamp duty and GST
  • Drafting, negotiating and advising in relation to commercial property transaction structure (joint venture, partnership, unitholder, and development agreements), financing arrangements, and ancillary documentation associated with property transactions
  • Before commencing in private legal practice, Damian gained experience, including in a commercial capacity, at a Melbourne-based property development firm
