Gina is a Principal in Russell Kennedy's Corporate and Commercial team, specialising in all aspects of Privacy, Data Protection, Information Technology and Intellectual Property.

Gina has a wealth of experience advising on all aspects of IP, including trade marks, designs, copyright, confidential information, domain names and consumer protection matters. Gina works with clients to manage the full lifecycle of their Intellectual Property from brand development, to forming protection strategies, to managing Australian and international portfolios, to commercialisation, strategic management, enforcement and disputes. Gina assists clients to proactively manage their intangible assets and establish mutually beneficial business relationships.

Gina regularly advises both public and private sector clients on their privacy and data protection obligations under the Privacy Act 1988 (Cth), Privacy and Data Protection Act 2014 (Vic), Health Records Act 2001 (Vic) and other legislation, particularly as these relate to software applications and the collection of information via new technologies. Gina assists clients with assessing and mitigating the privacy impacts of new projects and dealing with data sets used or collected in the course of the project. She also assists clients to deal with data breaches and in their interactions with the Office of the Australian Information Commissioner (OAIC).

Gina has significant technical expertise in structuring a range of software and technology agreements for both acquirers and suppliers of IT services and products. In particular, she has worked with clients to acquire IT services through the eServices Register and State Purchasing Contracts. Gina also assists clients to navigate and resolve disputes with IT service providers.

Gina regularly presents at seminars and conferences on a range of legal topics for clients and industry groups. Gina’s experience includes international experience working for a Japanese specialist IP firm and in-house, reporting to the Global IP Counsel of a leading international gaming company.

Experience

  • Assisting several clients to navigate cyber security incidents and comply with their legal and regulatory obligations;
  • Representing a Victorian Government body in negotiating contracts for acquisition and implementation of multi-million dollar IT system;
  • Advising Toronto-based healthcare technology company VitalHub Corp. on the IP and IT aspects of its acquisition of Australian cloud-based software provider Community Data Solutions; read more here.
  • Advising a Federal Government body on its rebrand including conducting clearance searches, advising on infringement risks and obtaining protection for suite of trade marks;
  • Advising a Victorian Government body in regard to a local trial of third party technology, including reviewing contracts with multiple stake-holders and advising on aspects including intellectual property, protection of data, confidentiality and privacy;
  • Assisting a Melbourne-based brewery to successfully defend claims of misleading and deceptive conduct, passing off and trade mark infringement in the Federal Court of Australia;
  • Negotiating a high stakes overseas trade mark acquisition for an Australian food marketing and distribution business;
  • Securing an order for the transfer of a domain name registered by a cyber-squatter on behalf of a world renowned stationery brand;
  • Managing extensive Australian and international trade mark portfolios for a number of high profile clients;
  • Advising a major ASX listed client in the financial services sector on IP/IT related aspects of acquisition of a finance, insurance and warranty business for $115m, and drafting and negotiating multiple IT procurement contracts; and
  • Drafting a suite of core contracts for a client's new SaaS data matching offering to the automotive industry.
