Rose is the head of Russell Kennedy’s General and Self Insurance team.

Rose has practiced extensively in the Insurance industry for over 30 years, acting for defendants. She has practiced predominantly in the defence of civil claims, comprising common law damages claims, statutory recovery claims and statutory benefits claims. Rose has also advised and represented corporate clients in relation to their statutory duties under the Occupational Health and Safety Act 2004 (OHS Act) and in product liability claims, particularly in asbestos-related injury claims.

Rose has acted in a broad range of disputes, of varying sizes and complexity, for defendants from a diverse range of industries and sectors. Her clients have included self-insurers, the Victorian WorkCover Authority, Sportscover, CSR Ltd and Paper Australia Pty Ltd. Her experience includes statutory benefits, personal injuries, product liability, statutory recovery claims, Occupational Health & Safety, coronial inquests and Dust Diseases. She has acted on behalf of clients in all Victorian Courts and in the Victorian Civil and Administrative Appeals Tribunal.

Experience

  • Strategic WorkCover claims management advice and investigation of claims on behalf of employers and self-insurers.
  • Extensive personal injury litigation experience acting for defendants in Victoria in all courts including appeals. Acted for employers, occupiers, manufacturers, host employers, boat and vessel owners, gymnasium owners and personal trainers, supermarkets, builders, developers and sub-contractors, football clubs, schools and universities in numerous personal injury claims.
  • Acted in catastrophic injury cases for insurer clients including a recent claim by a minor who was rendered a quadriplegic during a diving incident and associated recovery claims.
  • Acted for a former manufacturer of asbestos containing products in dust disease claims brought in the Dust Diseases List of the Supreme Court of Victoria.
  • Advised and acted in property damage claims on behalf of public liability insurers.
  • Prepared statutory notices and other documentation for WorkCover self-insurers and have attended to many settlements of claims for them.
  • Negotiated the commercially effective settlement of claims on behalf of public liability insurers and the Victorian WorkCover Authority.
  • Prepared a successful application for self-insurance on behalf of an employer.
  • Acted for an insurer in VCAT in response to a complaint that the insurer breached the Health Records Act 2001 and the Health Privacy Principles.
  • Acted for clients in a number of occupational health and safety investigations and prosecutions in the Victorian Magistrates’ Court
  • Drafted and negotiated the terms of enforceable undertakings for clients as an alternative to their prosecution under the Occupational Health and Safety Act 2004.
  • Acted for insurers in dual insurance recovery claims.
  • Provided coverage advice to a leading public liability insurer on a multi-million dollar product contamination and product recall claim.
