In March 2020, the Australian Human Rights Commission released the Respect@Work Report, containing 55 recommendations for policy and legislative reforms to address the prevalence of sexual harassment in the workplace.
Since that time, successive governments have enacted various pieces of legislation aimed at implementing the recommendations of this report, giving rise to some significant changes to employers’ obligations. Critically, the Federal Government has introduced a positive duty on employers to take reasonable and proportionate measures to eliminate, so far as possible, sexual harassment and related behaviours in the workplace.
Employers need to inform themselves of the details and implications of these changes, and plan the measures that are to be taken to eliminate incidents of sexual harassment and related behaviours.
This seminar will cover:
- The Respect@Work report recommendations as implemented
- The behaviours employers have a positive duty to eliminate – how to recognise and distinguish them
- What the new positive duty entails
- The risks for claims and actions
