Further to our article dated 15 April 2024, detailing ASIC’s first prosecution for failure to have a Director Identification Number (DIN), a pair of Western Australian directors have also been convicted and fined for the same offence. Alexander Henry and Luke David Mason were convicted on 3 May 2024 for failing to obtain a DIN in accordance with the Corporations Act 2001 (Cth). Mr Henry and Mr Mason were each fined $5,000 plus costs, and have until 31 May 2024 to apply to have their convictions set aside. Magistrate Crawford SM noted that significant efforts had been made by relevant government agencies to bring the accused’s attention to the scheme and achieve their compliance. These convictions serve as a reminder of the penalties that apply for non-compliance with the DIN requirements, and the ongoing engagement by the Australian Business Registry Services (ABRS) with directors who have not applied for a DIN.
