The Australian Capital Territory (ACT) Court of Appeal, has upheld the ACT Supreme Court’s decision in a case of medical negligence involving delays in diagnosing and treating a patient’s pancreatic cancer during her treatment at the Canberra Hospital, (the Hospital). The plaintiff in the original case, Mrs Alrifai, claimed the ACT (being the entity vicariously liable for the Hospital) failed to promptly address her cancer and alleged that this breach was the direct cause of personal harm. While an initial judgment found a breach of duty, the Supreme Court concluded that causation could not be substantiated regarding Mrs Alrifai’s injury.
