The deadline for directors appointed on or before 31 October 2021 to apply for their Director Identification Number (DIN) is 30 November 2022. Directors who do not have a DIN, and who have not yet applied for one, will need to apply by the due date to avoid penalties.
In 2020, the Commonwealth Parliament passed legislation for a new register of directors of Australian companies. Under this legislation, directors are issued their own unique DIN, with the aim of enabling better tracking of directors and their corporate histories, and to assist in combatting illegal phoenixing activity. The DIN regime has since been rolled out by the Australian Business Registry Services (ABRS) and directors appointed on or before 31 October 2021 have until 30 November 2022 to apply for a DIN.
Intending new directors must apply for a DIN before being appointed.
It is a criminal offence if directors do not apply on time and penalties may apply.
The Australian Taxation Office have published a ‘how-to’ video on their website that outlines the steps required in applying for a DIN. The video can be accessed here.
We regularly advise company directors as to their duties and responsibilities and can provide assistance in navigating the new DIN regime.
