Online training replay: Balancing Duty of Care and Dignity of Risk in Aged Care

On Wednesday 15 May 2024, Russell Kennedy hosted an online training session on how consumer choice and dignity of risk will have even greater prominence under the New Aged Care Act.

The training helps aged care providers understand the obligations with respect to consumers’ choice to take risks and live the life of their choosing, regardless of the possible consequences. However, the concepts of dignity of risk and duty of care are often poorly understood and is a difficult area for providers in a highly regulated environment.

This training assists providers and their workers to understand their legal obligations with respect to dignity of risk, as well as where to draw the line when the risk is too high.

In this session, we presented the following:

  • Understanding dignity of risk and duty of care.
  • Legal obligations with respect to dignity of risk.
  • The balancing act between dignity of risk and duty of care.
  • Understanding who can make choices for a care recipient where the care recipient is unable to do so.
  • Risk mitigation strategies and how to fulfil dignity of risk obligations.

We used case studies to explore the concepts and help staff feel more confident in understanding what choices they are required to respect and when they should say no.
